Green Tree Servicing v. Easley

The Ninth District Court of Appeals reversed summary judgment when my brief attacked the lack of personal knowledge in the servicer Ditech's affidavit and argued issues related to possession of the original note.​


Fed. Natl. Mtge. Assn. v. Ford

After a pro se homeowner in Cuyahoga County represented himself he had a judgment of foreclosure against him. I argued his case on appeal and the judgment was reversed.


Fed. Natl. Mtge. Assn. v. Walton

 I argued the case in the Eighth District Court of Appeals and the judgment related to the deed reformation was reversed.

Wells Fargo Bank, NA v. Goebel 

Homeowners with an FHA mortgage had the judgment of foreclosure reversed on appeal after my briefs argued that Wells Fargo failed to comply with HUD regulations, specifically the face to face meeting with the homeowners prior to filing for foreclosure. See also 2014 victory


Bank of Am. v. Smith

Bank of America filed a motion or summary judgment against a Cincinnati homeowner and the judgment was reversed on appeal after my briefs argued that the documents required for foreclosure were not properly authenticated.

Federal regulations govern the loan modification process and you may have a claim for damages for conduct that occurred after January 10, 2014.

-Dual tracking is prohibited in certain situations. In a foreclosure case a mortgage servicer cannot file a motion for default judgment or summary judgment against you while you have a pending home loan modification application. Servicers also cannot proceed with a sheriff's sale if you submit a complete mortgage loan modification application. This provides foreclosure relief, but servicers don't always follow foreclosure laws. If your rights were violated you may have a claim under the Real Estate Settlement Procedures Act (RESPA). -If you have been denied for a loan modification the denial letter sent to you may have been improper. You have a right to appeal the decision.

 

Even though the deadline to apply for HAMP has expired there are other loan modifications that you may qualify for!

Fannie Mae, Freddie Mac, FHA, and VA have loss mitigation programs. Mortgage servicers may have proprietary loan modifications programs available.
